Terms of Service

These terms apply to every booking made through madeirapicnicmoments.com. By submitting a booking request, you agree to the terms below.

1. Bookings

A booking request is not binding until a deposit has been received. Once the deposit is confirmed, we will send a written confirmation with the final details of your picnic experience.

2. Prices and payment

All prices are shown in Euro (EUR) at the time of booking. A deposit is required to confirm your booking, as shown during checkout; the remaining balance is due before the event, using the payment method agreed in your confirmation. Payments are processed securely via Stripe and/or PayPal.

3. Cancellations and changes

[CANCELLATION POLICY TO BE CONFIRMED — provisional: free cancellation up to 7 days before the event; the deposit is retained for cancellations made within 7 days of the event.] We may offer to reschedule your picnic free of charge in case of adverse weather conditions, at our discretion.

4. Right of withdrawal

Because our picnic experiences are leisure services performed on a specific date and time, they are exempt from the standard 14-day EU right of withdrawal for online purchases (Article 16(l) of Directive 2011/83/EU).

5. Liability

We take every reasonable precaution to ensure a safe and enjoyable experience. We are not liable for indirect damages, and our liability for direct damages is limited to the total amount paid for the booking, except where liability cannot be limited by law (e.g. gross negligence or personal injury).

6. Force majeure

Neither party is liable for delays or cancellations caused by events beyond reasonable control, including extreme weather, natural disasters, or government restrictions.

7. Governing law

These terms are governed by Portuguese law. Any dispute will be submitted to the courts of Funchal, Madeira, without prejudice to any mandatory consumer protection rights you may have under EU law. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
